I have 2007 e92 335i with n54, 58k miles. Noticed the wastegate rattle a few months ago. Made an appointment to take in to BMW of San Diego and get new turbos under the 8 year/82k mile recall.
Dropped it off this morning. I was told "its not a big deal, we have done many of these and you will have new turbos in two days, free of charge." I signed my $0 estimate and took off in the donor 128i.
Got a call this afternoon saying there was a problem. The SA, Glenn Widdop (very nice and professional) told me that my car is some rare case that is not covered because it was one of the first ever produced for MY 2007. He said the build sheet is different and the techs in Germany said that my car actually has different parts than other N54 335i's, although the SA "had not seen any empirical evidence of this." He also mentioned none of his colleagues or mechanics have heard of this before.
Glenn said he exhausted all possible options to get it completely covered. He said BMW is willing to do a good faith deal where they will cover 50% of the $4300 total price for turbo replacement. That drops to 40% when I hit 60k miles.
Have any of guys heard of this? Early N54's that weren't covered in the lawsuit? The settlement clearly states that MY 2007 e92 335i n54 are covered. It even goes beyond to state "from the beginning of production." I plan on calling BMW of NA first thing in the morning but if anyone has any advice or knows someone i can talk to that would be greatly appreciated.
